Waste Removal Highbury Terms and Conditions
These Terms and Conditions set out the basis on which Waste Removal Highbury provides waste and rubbish collection services to domestic and commercial customers. By booking a service, you agree to be bound by these Terms and Conditions. Please read them carefully before placing an order.
1. Definitions
In these Terms and Conditions, the following expressions have the meanings set out below:
1.1 Service means any waste, rubbish, junk, or debris collection, removal, loading, transportation, sorting, recycling, or disposal service provided by Waste Removal Highbury.
1.2 Customer means the person or business that requests or books the Service.
1.3 Property means the location from which waste is to be collected or to which equipment or personnel are to be sent.
1.4 Waste means any items, materials, or rubbish presented by the Customer for removal, including household waste, commercial waste, bulky items, green waste, and construction or renovation debris, except for excluded items as detailed in these Terms.
1.5 Agreement means the contract between Waste Removal Highbury and the Customer for the provision of Services, comprising these Terms and Conditions and the confirmed booking details.
2. Scope of Services
2.1 Waste Removal Highbury provides waste and rubbish collection, clearance, loading, transportation, and disposal services in accordance with applicable waste regulations and licensing requirements.
2.2 Unless expressly agreed in writing, the Service does not include cleaning, dismantling of fixed structures, disconnection of utilities, or removal of items that fall outside the permitted waste categories.
2.3 The Service is provided on the basis of the description and volume or weight of Waste supplied by the Customer at the time of booking. The final price and feasibility of the Service may be reviewed on arrival if the Waste differs from the original description.
3. Booking Process
3.1 Bookings can be made by telephone, email, or other communication methods made available by Waste Removal Highbury from time to time.
3.2 When making a booking, the Customer must provide accurate and complete information, including:
a. Full name and contact details.
b. Collection address and any access instructions for the Property.
c. A description of the type and approximate quantity of Waste to be removed.
d. Any relevant information about parking restrictions, access limitations, or special handling requirements.
3.3 Waste Removal Highbury will provide an estimated quote based on the information provided. This quote is not binding if the actual Waste or conditions differ significantly from the description given at the time of booking.
3.4 A booking is only confirmed when Waste Removal Highbury issues a confirmation by email, text message, or verbal confirmation and allocates a collection slot.
3.5 The Customer is responsible for securing any necessary parking permissions, permits, or access approvals in advance of the collection time unless otherwise agreed.
4. Service Access and Customer Obligations
4.1 The Customer must ensure that Waste Removal Highbury staff have safe, unobstructed access to the Property and to the Waste at the agreed time.
4.2 The Customer must ensure that the Waste is clearly identified and separated from items that are to be retained. Waste Removal Highbury is not responsible for the removal of items that were not clearly designated as Waste.
4.3 If Waste Removal Highbury is unable to access the Property or the Waste due to circumstances within the Customer's control, a call-out or wasted journey charge may apply.
4.4 The Customer warrants that they either own the Waste or have the authority of the owner to request its removal.
4.5 The Customer must inform Waste Removal Highbury in advance of any potentially hazardous conditions at the Property, including structural instability, contaminated areas, or other health and safety risks.
5. Pricing and Payments
5.1 Prices are typically based on factors including, but not limited to, the volume and type of Waste, loading time, labour requirements, access conditions, and disposal or recycling charges.
5.2 Any price estimate given prior to collection is an approximation based on the Customer's description. The final price may be adjusted on site where:
a. The Waste volume or type differs materially from the description provided.
b. Additional labour, time, or equipment is required.
c. Access or parking is more difficult than indicated at the time of booking.
5.3 Waste Removal Highbury will inform the Customer of any change to the quoted price before commencing the Service. If the Customer declines the revised price, a reasonable call-out or assessment fee may be charged to cover time and travel.
5.4 Payment is due on completion of the Service unless otherwise agreed. Waste Removal Highbury may require part or full payment in advance, particularly for larger or commercial bookings.
5.5 Accepted payment methods may include cash, debit card, credit card, or bank transfer, as communicated at the time of booking.
5.6 Where payment is not made on the due date, Waste Removal Highbury reserves the right to charge interest on overdue sums and to recover all reasonable costs of collection, including legal expenses.
6. Cancellations, Changes, and Missed Appointments
6.1 The Customer may cancel or reschedule a booking by giving notice to Waste Removal Highbury.
6.2 If the Customer cancels more than 24 hours before the scheduled collection time, any deposit paid may be refunded or transferred to a new booking at the discretion of Waste Removal Highbury.
6.3 If the Customer cancels less than 24 hours before the scheduled collection time, Waste Removal Highbury may retain all or part of any deposit paid and may charge a late cancellation fee to cover lost time and travel costs.
6.4 If Waste Removal Highbury attends the Property at the agreed time and is unable to carry out the Service due to the Customer's act or omission, including no access, no Waste available, or unsafe conditions, a call-out charge or minimum load fee may apply.
6.5 Waste Removal Highbury reserves the right to cancel or reschedule a booking due to circumstances beyond its reasonable control, including severe weather, traffic disruption, vehicle breakdown, staff illness, or safety concerns. In such cases, Waste Removal Highbury will seek to offer an alternative slot as soon as reasonably practicable.
7. Waste Types and Exclusions
7.1 The Customer must clearly disclose any hazardous or specialist Waste in advance of booking. This includes, but is not limited to:
a. Chemicals, solvents, oils, or fuel.
b. Asbestos or materials containing asbestos.
c. Clinical, biological, or medical Waste.
d. Pressurised containers, gas cylinders, or explosives.
e. Paints, batteries, or electrical equipment that require special handling.
7.2 Waste Removal Highbury may, at its sole discretion, refuse to remove any item it considers unsafe, unlawful to transport, excessively heavy or bulky, or beyond its normal service scope.
7.3 If undisclosed hazardous or prohibited Waste is discovered at the time of collection, Waste Removal Highbury may refuse to remove it and may charge a fee for the wasted journey and time spent on site.
8. Compliance with Waste Regulations
8.1 Waste Removal Highbury will transport and dispose of Waste in accordance with applicable UK waste management regulations and will use appropriately licensed facilities.
8.2 A waste transfer note or equivalent documentation may be issued or maintained as required by law. The Customer agrees to provide accurate details if needed for regulatory documentation.
8.3 Once the Waste has been collected and payment made, legal ownership of the Waste passes to Waste Removal Highbury, which will handle it in accordance with regulatory obligations and internal environmental policies.
8.4 Waste Removal Highbury aims to minimise landfill and may sort and divert suitable materials for reuse or recycling where feasible. However, no guarantee is given regarding specific recycling or recovery outcomes.
9. Customer Warranties and Indemnity
9.1 The Customer warrants that:
a. They have full authority to contract for the removal of the Waste.
b. The Waste does not contain undisclosed hazardous materials or items prohibited by law.
c. Any information provided about the Waste and the Property is accurate and complete.
9.2 The Customer will indemnify Waste Removal Highbury against all claims, losses, damages, costs, and expenses arising from:
a. Any breach of these warranties.
b. The presence of hazardous or prohibited materials not disclosed in advance.
c. Any claim by a third party alleging that the Customer did not have the right to dispose of the Waste.
10. Liability and Limitations
10.1 Waste Removal Highbury will exercise reasonable care and skill when providing the Service. However, the Customer is responsible for protecting walls, floors, fixtures, and fittings from damage that could reasonably result from the normal removal of Waste.
10.2 Waste Removal Highbury is not liable for:
a. Wear and tear or pre-existing damage at the Property.
b. Damage that arises from the removal of items in circumstances where access is restricted and the Customer has been advised of the risk.
c. Loss of or damage to items that were not clearly identified as Waste but were reasonably understood to be Waste based on their location or presentation.
10.3 If damage occurs due to the negligence of Waste Removal Highbury, the Customer must notify Waste Removal Highbury in writing as soon as reasonably practicable and in any event within 7 days of becoming aware of the issue.
10.4 To the fullest extent permitted by law, Waste Removal Highbury's total liability to the Customer, whether arising in contract, tort, or otherwise, is limited to the total price paid or payable for the specific Service giving rise to the claim.
10.5 Nothing in these Terms and Conditions excludes or limits liability for death or personal injury caused by negligence, for fraud, or for any other liability that cannot lawfully be excluded or limited.
11. Delays and Events Beyond Control
11.1 Waste Removal Highbury will use reasonable efforts to complete collections at the agreed time but cannot guarantee exact arrival times due to traffic, road conditions, and other operational factors.
11.2 Waste Removal Highbury is not liable for delays or failure to perform any part of the Service where such delay or failure is caused by events beyond its reasonable control, including but not limited to extreme weather, road closures, accidents, or regulatory interventions.
12. Complaints and Dispute Resolution
12.1 If the Customer is dissatisfied with any aspect of the Service, they should contact Waste Removal Highbury as soon as possible so that any issues can be investigated and addressed.
12.2 Waste Removal Highbury will review complaints in good faith and may request additional information or evidence, including photographs or written details of the concern.
12.3 Where appropriate, Waste Removal Highbury may offer a remedy such as a partial refund, a discount on future services, or a return visit, but any remedy is offered at the sole discretion of Waste Removal Highbury and without admission of liability, unless otherwise required by law.
13. Data Protection and Confidentiality
13.1 Waste Removal Highbury will handle Customer personal data in accordance with applicable data protection laws and only for purposes connected with the provision of Services, administration, and legal compliance.
13.2 Customer information will not be sold to third parties. It may be shared with service partners, insurers, or regulators where necessary to perform the Service, manage risk, or comply with legal obligations.
14. Variation of Terms
14.1 Waste Removal Highbury may update or amend these Terms and Conditions from time to time. The version in force at the time of the Customer's booking will apply to that Service.
14.2 Any changes to the scope of the Service or to pricing agreed after the initial booking must be recorded in writing or confirmed verbally and noted in the service records.
15. Severability
15.1 If any provision of these Terms and Conditions is held to be invalid, unlawful, or unenforceable by a court or competent authority, that provision will be deemed severed and the remaining provisions will continue in full force and effect.
16. Governing Law and Jurisdiction
16.1 These Terms and Conditions, and any dispute or claim arising out of or in connection with them or their subject matter, are governed by and construed in accordance with the laws of England and Wales.
16.2 The parties agree that the courts of England and Wales will have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms and Conditions or the provision of the Services.
By booking a rubbish or waste collection with Waste Removal Highbury, the Customer confirms that they have read, understood, and agree to these Terms and Conditions.
